Understanding Visitor Visas with GM Law

Whether you want to experience Canada’s breathtaking landscapes, visit loved ones, or explore business opportunities, a visitor visa is your key to entering this diverse and welcoming country. At GM Law, we provide comprehensive legal guidance to assist you in navigating the visitor visa process, helping you to embark on your Canadian journey with confidence and ease

An Overview of the Visitor Visa

A Visitor Visa, also known as a Temporary Resident Visa (TRV), allows you to stay in Canada for a temporary period, usually up to six months. It’s the legal document that permits you to enter and remain in Canada as a visitor. Visitors on a TRV are not allowed to work or study in the country but can engage in tourism, visit family, and conduct certain business activities.

Exploring the Eligibility Criteria for a Visitor Visa

Securing a visitor visa for Canada is dependent on meeting a specific set of eligibility criteria. These are designed to assess the intent and ability of the prospective visitor to respect the terms of their entry into Canada. The key eligibility factors include:

  1. Ties to the Home Country: Prospective visitors must establish strong ties to their home country. These ties, which can be family, financial, or occupational, should indicate the individual’s likelihood of leaving Canada at the end of their visit.
  2. Financial Means: Visitors are expected to have enough funds to cover their expenses during their stay in Canada and for a return ticket. This financial capability must be demonstrated convincingly.
  3. Good Health: Canada seeks to protect its public health system. Therefore, depending on the visitor’s age and the length of stay, a medical examination may be required.
  4. Clean Record: Canada places high importance on safety. Hence, having a criminal record or posing a security risk can affect visa approval.
  5. Invitation Letter: If the purpose of the visit is to see family or friends, an invitation letter from them can add strength to the application.
  6. Purpose of Visit: A clear and well-justified purpose of visit is crucial. The visitor should be able to explain why they wish to visit Canada and what they plan to do during their stay.

Types of Visitor Visas

There are two main types of visitor visas: Single Entry and Multiple Entry.

Single Entry Visa

A Single Entry Visa allows the holder to enter Canada once. Upon leaving Canada, excluding travel to the United States and St. Pierre and Miquelon, a new visa must be obtained to re-enter Canada. This type of visa is valid for up to six months from the date of entry.

Multiple Entry Visa

A Multiple Entry Visa allows the holder to enter and exit Canada multiple times within the validity of the visa. This type of visa gives the flexibility to travel in and out of Canada till the visa expires. The maximum duration for each stay is typically six months

Visitor Visa Extensions

The vibrant cities, scenic beauty, and warm hospitality of Canada often make visitors wish to extend their stay. Whether you want to continue exploring the landscapes, spend more time with your loved ones, or finalize business dealings, extending your stay in Canada is a possibility under certain conditions.

Your stay in Canada is governed by the duration on your entry stamp, or if you have a visitor visa, the date it expires. As a visitor, you typically can stay for up to six months from the day you entered Canada. However, if you wish to stay longer, you must apply for an extension, and this must be done while your current status is still valid.

The application to extend your stay is known as a visitor record, a document that gives you visitor status in Canada and sets a new date by which you must leave. Note that it’s not a visa and doesn’t allow you to re-enter if you leave Canada.

To be eligible to apply for an extension, you should:

Have a valid reason for wanting to extend your stay.

Continue to meet the initial entry requirements, including leaving at the end of the period authorized for your stay.

Apply at least 30 days before the expiry of your current status.
